Élevé With Brogan Wellness: Privacy Policy, Disclaimers & Your Rights
Last updated: Oct 9, 2026
Privacy Policy
Élevé With Brogan Wellness ("we", "us") is owned and operated by Brogan Cyr in Saskatchewan. This policy explains what personal information we collect, how we use and protect it, and the rights you have over it. By using our website, joining our email list, or registering for a program or coaching service, you agree to the practices described here.
We handle personal information in line with the following laws:
• Personal Information Protection and Electronic Documents Act (PIPEDA), S.C. 2000, c. 5: the federal law governing how private businesses collect, use and disclose personal information in the course of commercial activity. Saskatchewan has no private-sector privacy statute of its own, so PIPEDA applies to us.
• Canada's Anti-Spam Legislation (CASL), S.C. 2010, c. 23: governs commercial electronic messages, including marketing emails and texts.
• The Privacy Act (Saskatchewan), R.S.S. 1978, c. P-24: protects against unreasonable violations of privacy, including using a person's name, image or likeness without consent.
• The Consumer Protection and Business Practices Act (Saskatchewan), S.S. 2013, c. C-30.2: requires honest advertising and fair dealing with clients.
Saskatchewan's Health Information Protection Act applies to regulated health care "trustees" and not to fitness coaching. We nonetheless treat any health-related information you share with us as sensitive.
What we collect and how
We collect only what is reasonably needed to run our programs and communicate with you.
Contact details (name, email, phone, mailing address): collected through website forms, email signup, registration, direct messages and email.
Program and coaching details (goals, schedule, attendance, assessment results, progress notes): collected through registration, in-person assessments, check-ins and online coaching.
Health information, which is sensitive (time since birth, physician clearance, injuries, pelvic floor or core concerns, conditions relevant to training): collected through intake and screening forms and conversations with you.
Nutrition information (food habits, dietary preferences, goals): collected through nutrition coaching intake and check-ins.
Payment details (amount, date and payer name): collected through e-transfer or our payment processor. We do not store full card numbers.
Website and social data (IP address, device, browser, pages viewed, cookies): collected through Squarespace analytics and social media platforms.
We do not knowingly collect information directly from children. Babies who attend sessions are covered by their parent's or guardian's registration.
Why we use your information, and consent
We use your information to:
• register you for and deliver our programs and coaching services;
• assess whether a program is suitable for you and adapt exercises safely;
• communicate about schedules, changes and your progress;
• process payments and keep business and tax records;
• send marketing emails, only if you have opted in (see Email Marketing below); and
• meet our legal obligations.
We ask for your consent before collecting, using or sharing your information. Health information is sensitive, so we seek your express (clearly stated) consent, usually through your signed registration or intake form. We will not use your information for a new purpose without asking you first. We never sell or rent your personal information.
Storage, security, sharing and retention
Safeguards. We protect your information with password-protected devices and accounts, two-factor authentication where available, limited access, and locked storage for any paper forms.
Service providers. We use trusted third parties to run the business, such as Squarespace (website and forms), Google (email and file storage), and our email marketing and payment providers. They may access your information only to perform their services. Apart from these providers, we share your information only with your consent or where the law requires it.
Storage outside Canada. Some providers store data on servers in the United States or elsewhere. Your information may therefore be subject to the laws of those jurisdictions, including access by their courts or authorities.
Retention. We keep information only as long as needed:
• Registration and health screening forms: two years after your last service, then securely deleted or destroyed.
• Financial and payment records: six years, as required by the Canada Revenue Agency.
• Email subscribers: until you unsubscribe, then only a record of your opt-out.
Breaches. If a breach of our safeguards creates a real risk of significant harm to you, we will notify you and report it to the Office of the Privacy Commissioner of Canada, as PIPEDA requires. We keep a record of every breach for 24 months.
Your privacy rights
Under PIPEDA, you have the right to:
• Access the personal information we hold about you and learn how it has been used and shared;
• Correct information that is inaccurate or incomplete;
• Withdraw consent to our collecting, using or sharing your information, subject to legal or contractual limits (withdrawing may mean we can no longer provide a service); and
• Complain about how we have handled your information.
To make a request, email elevewithbrogan@gmail.com. We may need to verify your identity, and we will respond within 30 days.
If we have not resolved a concern to your satisfaction, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca or 1-800-282-1376.
